Abstract:

Procedural characteristic within the scope of the Civil Procedure Law  The idea of the procedural character, which is basically an important element of the lawsuit and one of the conditions for its validity or requirements, according to Article 4 of the Iraqi Civil Procedure Law, is summarized as an important part that must be present in order to accept the lawsuit, without this character there is no claim of something. The judge may not accept the case or decide on it unless all its requirements for obtaining judicial protection are completed.
